A Solano County Superior Court jury on Wednesday convicted a 47-year-old Fairfield man of a 2021 road rage shooting in Fairfield.
Marcial Cardenas Pineda faces up to 19 years in state prison at his sentencing, set for 1:30 p.m. Dec. 15 in Department 7 in the Justice Building in Vallejo, where the trial was held.
Jurors found Pineda guilty of shooting at an occupied motor vehicle and assault with a semi-automatic firearm. They also found true the allegation that Pineda used a firearm to commit the crimes, Solano County District Attorney Krishna Abrams noted in press statement released Thursday afternoon.
Court records show that on Sept. 21, officers responded to a call of a suspected road rage shooting incident.
The victim was travelling on Interstate 80, taking the Waterman Boulevard/ Air Base Parkway exit when she noticed Pineda’s vehicle driving erratically.
After exiting the freeway, the Pineda rolled down his window and fired a single shot toward the victim, striking her vehicle, then fled the scene.
Pineda was later spotted by police in a parking lot near Beck Street and Cadenasso Drive in Fairfield and taken into custody.
“The victim courageously testified at trial, reliving this very frightening incident,” Abrams added in the prepared statement. “She was extremely brave to face the shooter while testifying in court.”
Abrams did not indicate the victim’s possible relationship to Pineda, but jail records show that he also was charged with corporal injury to a spouse or cohabitant and willful cruelty to a child, with possible injury or death, both misdemeanors.
Other misdemeanor charges against him included one count of DUI of alcohol, and one count of having a blood-alcohol content of 0.08 percent or greater.
Pineda remains without bail in Solano County Jail in Fairfield.
Deputy District Attorney Ashlee Thomas prosecuted the case, and Fairfield Police OfficerLauren Gomez was the primary investigating officer.
